Agreement Overview

These Terms of Service (“Terms”) govern the use of Animal Genius (also known as “Classtopia”) by educational institutions, schools, and districts (“School” or “You”). By creating teacher accounts or using our platform with students, you agree to these terms on behalf of your educational institution.

Animal Genius is an educational assessment platform designed to help teachers understand their students through personality quizzes and interactive classroom activities. We are committed to supporting education while maintaining the highest standards of student privacy and data protection.

School Authority & Educational Consent

FERPA Authority

Under the Family Educational Rights and Privacy Act (FERPA), schools have the authority to use educational technology services for legitimate educational purposes. By using Animal Genius, you confirm that:

  • You have the authority to provide consent for educational technology on behalf of your students
  • The use of Animal Genius serves a legitimate educational purpose in your curriculum
  • You will ensure appropriate adult supervision during platform use
  • You will comply with your school’s policies regarding educational technology

COPPA Compliance

For students under 13, Animal Genius operates under the “school consent” provision of the Children’s Online Privacy Protection Act (COPPA). You acknowledge that:

  • You are providing consent for the collection of student information for educational purposes
  • You have obtained any necessary parental permissions required by your school policies
  • Student information will be used exclusively for educational assessment and classroom activities
  • You can request access to or deletion of student data at any time

Educational Use & Restrictions

Permitted Uses

  • Conducting personality assessments to help students understand their strengths and differences
  • Facilitating classroom discussions about teamwork, communication, and learning styles
  • Using assessment results to inform teaching strategies and classroom management
  • Engaging students with interactive activities and virtual rewards for participation
  • Tracking student progress and completion of educational activities

Prohibited Uses

  • Using the platform for commercial purposes or generating revenue
  • Sharing student login credentials or data with unauthorized third parties
  • Using assessment results for high-stakes decisions affecting student advancement
  • Allowing unsupervised access by students under 13
  • Modifying, reverse engineering, or attempting to access unauthorized areas of the platform
  • Using the platform in ways that violate student privacy or applicable laws

Teacher Community & Messaging Conduct

Classtopia includes an educator-only community (“Zoo Keepers”) with posts, replies, and — when enabled — private direct messages between teachers. These features are for professional collaboration between educators. Students never have access to them.

Conduct Expectations

  • No harassment, bullying, hate speech, or threatening behavior toward other educators
  • No spam, commercial solicitation, or unsolicited promotional messaging
  • Do not share student personal information in posts or messages beyond the platform’s first-name-and-last-initial convention
  • Respect other teachers’ choices to block or decline messages

Moderation

  • Direct messages are private between the participating teachers; Classtopia staff do not read them in the ordinary course of operating the platform
  • When a message is reported, the reported message and limited surrounding context are shared with Classtopia administrators for review, and a copy is retained as a moderation record
  • We may hide content, restrict a teacher’s community or messaging access, or terminate accounts that violate these terms

School Responsibilities

Student Privacy & Safety

  • Ensure teacher accounts are created and managed by authorized school personnel
  • Provide appropriate supervision when students access the platform
  • Train teachers on proper use of student data and privacy protection
  • Notify parents about the use of educational technology as required by school policy
  • Report any suspected data breaches or privacy concerns immediately

Data Management

  • Regularly review student data and remove inactive or graduated students
  • Ensure teachers understand how to access and interpret student assessment results
  • Maintain records of consent and permission as required by school policies
  • Coordinate data export or deletion requests as needed

Technical Requirements

  • Ensure adequate internet connectivity and device access for students
  • Provide technical support for teachers and students using the platform
  • Maintain current web browsers and security updates on school devices
  • Follow school IT policies regarding external educational platforms

Your Data Rights & Control

As the educational institution, you maintain significant control over student data:

Access Rights

  • View all student quiz results and progress data for your classes
  • Export student information and assessment results in standard formats
  • Access detailed reports on student engagement and activity
  • Review platform usage statistics for your school

Deletion Rights

  • Request immediate deletion of specific student records
  • Remove entire classes or grade levels as needed
  • Delete all school data if you discontinue use of the platform
  • Ensure data is permanently removed from our systems within 30 days of request

Control Features

  • Control student access to specific platform features
  • Set class-specific privacy and participation settings
  • Monitor and audit teacher and student platform usage

Service Reliability

  • Provide advance notice of any significant service changes
  • Offer data export tools to prevent vendor lock-in
  • Respond promptly to technical support requests

Fees, Subscriptions & Renewal

Prices & Payment

Prices, plan features, billing frequency, and any applicable taxes are shown before you purchase. Self-service paid subscriptions are billed in advance for a one-year term. If a separate order form or invoice states different billing terms, those billing terms control for that purchase. By purchasing a subscription, you authorize us and our payment processor to charge the payment method you provide for the initial term and each renewal term.

Automatic Renewal

Each self-service Classroom Zoo or Multi-Class Zoo subscription renews automatically for successive one-year terms until canceled. A renewal is charged at the price disclosed for your subscription, subject to any price-lock commitment shown when you purchased. If a subscription is not covered by a price lock, we will provide advance notice as required by applicable law before a price change applies to a future renewal.

Cancellation

You may cancel a self-service subscription at any time from Plan & Billing in your teacher account. Cancellation takes effect at the end of the period you have already paid for, so you retain access through that date and will not be charged for another renewal. Plan downgrades also take effect at renewal and do not receive a mid-cycle credit or refund. Canceling a subscription does not, by itself, close your account or delete school or student data; account closure and data deletion are handled separately as described below.

Refunds

We will refund a confirmed duplicate or incorrect charge. Other subscription fees are nonrefundable except where required by law, although we may approve a goodwill refund on a case-by-case basis. We do not provide automatic prorated refunds for unused time. To request a refund, contact us through the in-app support messenger while signed in to your teacher account. If you cannot sign in, use the monitored billing-support fallback shown on the teacher login page. For Classroom Zoo and Multi-Class Zoo, issuing a refund does not automatically cancel the subscription or change the access period; if you also want to prevent renewal, you must cancel the subscription separately. School Partnership purchases are invoice-based, do not renew automatically through the self-service portal, and use non-overlapping access terms. Under the normal process, a renewal invoice is issued only after the current paid term ends. Only a successful refund to the original payment method that fully covers the current invoice funding a School Partnership term ends that term. Partial, pending, or failed refunds, account credits, and refunds of older invoices do not end the current term. If Stripe later reports that the refund failed, we restore any unexpired access that refund caused to end. If automatic restoration cannot be confirmed, we will verify and correct access manually.

Service Availability & Support

Platform Availability

We strive to maintain 99% uptime for Animal Genius, with scheduled maintenance occurring during non-peak educational hours when possible. We will provide advance notice of any planned downtime that may affect classroom activities.

Technical Support

  • Authenticated teachers can contact support through the in-app help messenger
  • Comprehensive help documentation and teacher guides
  • Video tutorials for common platform features
  • Support for billing, refunds, data export, and deletion requests

Service Modifications

We may update or modify Animal Genius to improve educational outcomes and maintain security. Significant changes that affect data collection or student privacy will be communicated to schools at least 30 days in advance.

Limitation of Liability

Animal Genius is provided as an educational tool to support classroom learning. While we strive for accuracy and reliability, you acknowledge that:

  • Personality assessments are for educational discussion purposes, not diagnostic evaluation
  • Results should be interpreted by qualified educators within appropriate classroom context
  • The platform supplements but does not replace professional educational assessment
  • Schools maintain responsibility for appropriate use and interpretation of results

To the fullest extent permitted by law, Animal Genius and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our platform.

Account Termination & Data Deletion

School-Initiated Termination

You may discontinue use of Animal Genius at any time by:

  • Contacting us through the in-app support messenger to request account closure
  • Requesting immediate data export if desired
  • Confirming data deletion preferences

Canceling a paid subscription prevents its next renewal but does not automatically close the account or request deletion. Tell us through the in-app support messenger if you also want the account closed or its data deleted.

Upon termination, we will delete all student data within 90 days unless you request otherwise.

Service-Initiated Changes

If we need to discontinue or significantly modify Animal Genius, we will provide schools with at least 120 days advance notice and offer data export tools to facilitate transition to alternative platforms.

Legal Framework

These Terms of Service are governed by the laws of the United States and the state where Animal Genius operates. Any disputes will be resolved through good faith negotiation, with binding arbitration as a final resort.

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
